SMARTER CAR RENTALS
SMARTERSCOOTS TERMS OF SERVICE / RENTAL AGREEMENT AND RELEASE POLICIES
I hereby acknowledge and agree to the following rental agreement Terms and Conditions:
On pavements and pedestrian areas, riding speed is that of a walking pace, no fast riding is allowed.
Kick scooter- Age of driver 16 years old +; No passengers; Weight restriction – maximum weight 110kg; Speed restriction 20km p hour.
3 - wheelers- Age of driver 16 years old +; No passengers; Weight restriction – maximum weight 150kg; Speed restriction 20km p hour.
The rental agreement will be terminated on the spot, without refunds, if there is any breach of the above restrictions.
Kick scooter and 3-wheeler Smartscoots are rented out clean and in proper working condition and must be returned in the same manner. It is the responsibility of the client to check the Smartercoot BEFORE setting out on any ride.
Helmets are included in the rental price and are required to be worn at all times while riding Smartscoots rented from Smarter Car Rentals.
Customer agrees to return the helmets and Smartscoots in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. Customer accepts use of the equipment, AS IS, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Some of or all of the deposit will be withheld in the event of any damage whatsoever caused. Clean condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. Hourly and daily rentals are due back no longer than 15 minutes after rental period. Late returns are subject to fees equivalent to another full hour.
Customer agrees to provide SMARTER CAR RENTALS with a copy of customer ID number or Passport number, as well as credit card details, for precautionary use only:
I authorize SMARTER CAR RENTALS to charge the credit card they have on file for me for all eventual costs – up to 300 euros - in case of damages to the Smarterscoot during my rental period, comprehensive of third party damage - personal or property, except in the case that I can demonstrate other’s faults with evidence and all necessary information for reimbursement. In case of theft, I will be responsible for reimbursing SMARTER CAR RENTALS for the original price of the Smarterscoot, plus the cost of any accessories that were provided at the time of the Smartscoots rental.
Customer agrees that the hire of a Smarterscoot is for his/her own personal leisure and at his/hers own personal risk.
ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT
Assumption of Risk: I understand and accept that renting this Smarterscoot and participating in riding exposes me/my child to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I/my child should be in good physical health to participate in riding, and I confirm that I/my child have no significant health issues that prevent me/my child from participating in riding. I/my child have no medical conditions, nor have I/my child been diagnosed with a condition that prevents me from riding. In spite of the aforementioned risks and acknowledgements, I hereby assume all risk of injury or loss of life to myself/my child and loss of or damage to property arising out of renting this Smarterscoot and participating in riding. I understand the inherent risk involved in using this rental equipment and accept full responsibility for any and all such damage or injury which may result.
Waiver And Release: In consideration of SMARTER CAR RENTALS renting me/my child this Smarterscoot, I specifically release and forever discharge SMARTER CAR RENTALS and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to third parties or properties which I/my child may suffer / cause while renting this Smarterscoot and participating in riding . This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of SMARTER CAR RENTALS or its affiliates, officers, agents, or employees. It is my intent by the Waiver and Release Agreement to release SMARTER CAR RENTALS and hold the company harmless from all liability for any such property loss or damage, personal injury or loss of life. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me/my child while I am engaged in renting this Smarterscoot or participating in riding , I will have no right to make a claim or file a lawsuit against SMARTER CAR RENTALS or its affiliates, officers, agents or employees.
A helmet must be worn at all times and I realize the importance of wearing a helmet; I understand that this activity may result in severe injury, disfigurement, disablement or death; I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions; I understand that there are no scooter lanes in Malta; SMARTER CAR RENTALS staff have answered any questions I have had; I understand these Smartscoots may not have visibility enhancement equipment such as blinking lights.
I HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
By signing for a minor, I am agreeing that I am their parent or legal guardian and am releasing SMARTER CAR RENTALS from any claims, lawsuits or responsibilities for that minor. Each of the undersigned has read this AGREEMENT FOR USE OF SMARTERSCOOT AND RELEASE AND WAIVER OF LIABILITY.
I hereby agree to the above Terms of Service/ Waiver and Assumption of Risk.
